How do DUI arrests happen in Orange County?
There are three basic scenarios:

  • A police officer or CHP (California Highway Patrol) officer observes a driver’s erratic or suspicious-looking driving
  • A driver collides with another vehicle or stationary object, and law enforcement officers arrive at the scene
  • A traffic roadblock / screening identifies a driver who seems drunk or under the influence of drugs

Orange County and California officers receive very detailed training regarding the indicators of drunk driving and behavior that suggest an individual is drunk or drugged. Even so, it is estimated that about 40% of the time when an officer arrests a driver suspected of DUI, the person is not, in fact, intoxicated.

Driving Tactics that Risk a DUI Arrest
The most common indicators of driving under the influence for which police or the CHP will stop and arrest a driver are:

  • straddling the center line or a lane marker
  • the driver appears to be drunk
  • the vehicle almost strikes an object or another vehicle
  • weaving, swerving
  • driving on a surface other than designated roadway

These aren’t the only indicators of DUI, of course. Speeding, going too slow, and many other errors of judgment suggest that the driver may be under the influence of a drug or alcohol. If the officer who arrested you mentions any of these DUI indicators, be sure to tell your defense attorney about it. These indicators are not necessarily proof that you were driving under the influence.
